Susan, I hadn't heard of this program until just this minute, so I had to do some research. Here's a link to the states that participate (24 currently) and the statute that sets out the rules in each state. From looking at my own state's guidance, it appears the individual enrolling in the program ...

SUCCESS - IRS FIRE - I got a new TCC #! First, a HUGE thank you to Cecelia for bringing the situation with the IRS's requirement for a new TCC number to my attention. We've been working on our 1099s like normal, but had no idea this was an issue. I wanted to give everyone a ray of hope because I just ...

All, I think we just avoided a potential buyer fraud, a new sort I haven't seen talked about recently and wanted to let you all know the details so you can watch out for it. We received a contract a few weeks ago from a local realtor for four vacant town lots for cash. The property wasn't actually ...

I've thought long and hard about how to answer this question since it first came up because I come at the question from two different perspectives. First, as a title professional and paralegal, it would be a useful and timesaving tool to draft preliminary documents and complicated explanations of title ...

Paid with recording fees at County Clerk's office Are there exemptions? No What else should I know? There are several western slope ...

We're fortunate in Texas, because a Title Commissioner's ruling back in 1999 required that any realtor disbursements not shown in the contract be disclosed on the HUD/CD which is signed by the parties. A post closing change like you're suggesting would require a new HUD/CD be signed. When I get asked ...

Hi! :) I started in real estate law way back in the early 1980s in Colorado. My attorney purchased a title company and I found myself having to do searches and found I really liked it, and I was really good at tracking down weird title chains. I got to experience the fallout of the S&L crisis first ...

Tendi, It depends entirely on your state's rules regarding good funds. In my state, Texas, debit and credit cards haven't been approved as a source of good funds. But paper checks up to (but not exceeding) $499.00 are, and money orders up to $1,500.00 are. You'll need to check to see how it's allowed ...

Henry, I'm trying to understand your question. When you say "civil vs. common" are you referring to the difference between movable/immovable vs. personal/real property as it relates to buildings, water, minerals, etc. or something else? I should also mention that Texas doesn't use ALTA forms or guidelines. ...

Our office stopped a mortgage fraud during a refinance by determining the named homeowner who had gotten the mortgage when the property was purchased in the late 90s had died and it was actually the daughter (with the same first and last name) who was trying to get a cash-out refi. There had never been ...
