Unfortunately I don't see the lenders getting on board with this as they won't make money on the new loans and don't want to get stuck with the low interest rate mortgages. I agree with Nancy. It depends on the language of the contract, and in some cases, the state law that governs the contract. The best way to solve this is to carefully craft the inspection waiver to state that they accept the property as is, where is, or specifically state the limits of what the seller ...

By law in Virginia, the only things you can disburse prior to recording are the Clerk's check and any overpayment.
