  • 1.  Title Insurance Disclosure Requirements?

    Do any in the community work in a state where attorneys are title agents? Do you have any requirements that the attorney give a disclosure about their status as an agent for the sale of the policy in conjunction with issuance of an owner's policy in the course of a residential closing?

    Our State requires disclosure.  Attorneys in our state write title insurance and must disclose a financial interest in the "title premium".  I've attached a sample of the 2021 Disclosure provided by ORNT.  Not all our companies provide us with the form but we DO have to have them executed so we modify this one for use with ALL our title companies because it meets the state requirements for disclosure as determined ty the title insurer.

    SC Code §38-75-960(A)(1976) requires that we provide disclosure about the commission received by our agency and the licensed agents for owner's policies.

    Good morning Ruth.

    In IL, attorneys act as the title agent on most buy/sell transactions. The IDFPR, regulatory body for title insurance, promulgated a disclosure form in 1997, the DS-1 form, and the form is supposed to be sent to the parties prior to the title commitment being issued.

    There has been litigation over attempts to revise the DS-1, but the 1997 version is still in use.

    My firm is the issuing agent, so there is no need for an additional disclosure (at least in Florida)

    Hi Ruth,

    In MD, DC & VA, attorneys must carry a title insurance producer's license, just like anyone else, whether they are issuing the insurance or they are an approved attorney.  All three jurisdictions have a statutory disclosure regarding title insurance and the fact that the title agency is receiving a portion of the premium as compensation for services rendered.  Hope this helps.  Feel free to reach out directly if you need more information.
