  • 1.  LENDER NDAs is a new thing?

    We've seen our 2nd request in a short period of time from a lender asking us to sign their Non-Disclosure Agreement from (or Confidentiality Agreement) which binds us to penalties to them if we have some kind of data breach. Is anyone else seeing these? What are you doing about them?

    The last one I received, I took their form and recreated it with the same language but inserted our company as the assured party and I told them if they signed ours I would sign theirs. They waived the requirement.
