Hello!!
We received a call this morning where the escrow officer asked us what was the right course when presenting with CONFLICTING INFORMATION,
On one side she has a signed "certificate of non foreign status" given by a married couple, the husband is physically present in the U.S. but the wife is out of the U.S. in a foreign country, with no visa and no U.S. passport or Green card.....
In this (specific) case FIRPTA applies on the 50% of her share since she does not meet the requirements to be exempt, and NO, she cannot allocate her half to her husband and avoid complying with FIRPTA requirements by IRS rules.
