    I have a file in which we submitted the W-7 and 8288-B to the W-7 address as shown.

     

    It has been 11 months since we show they received it and still no word.  Is this normal?

    Is not normal, ITIN applications submitted with FIRPTA forms are processed in about 6 to 10 weeks, Have you or the applicant received an IRS letter requesting additional information? Please feel free to give me a call, we will be glad to assist you anywhere we can.

    Thank you Mary,

    The sellers applied for a reduced amount also and they have not heard anything.  I have receipt that the treasury, IRS, received the submission.

    I have called 3 times and been told they are behind?

    I s there anything I should do to protect us?

    Hi David,

    I agree with Mary. 11 months is not a normal processing time for the ITIN application, but it is normal for the 8288-B. In my experience, withholding certificates are taking anywhere from 12 to 18 months or more. Back in the good old days (before Covid) these applications were taking 90-120 days, but those days are long gone. Until the IRS can get the processing times under control, I would not recommend submitting these applications. 99.9% of the time, sellers can get back their appropriate refund faster by NOT applying for a withholding certificate. 

    Regarding the ITIN application, when the ITIN unit receives an application based on FIRPTA, it is supposed to receive priority processing. There are three possible outcomes: approved, rejected, or suspended for more information with all communications going to the address shown on line 2. Did you check with the seller to see if they received any correspondence? They would have received it approximately 2 months after the closing, so it's possible they forgot they received it. You'd be surprised how often this happens. 

    Mary and I are both Certified Acceptance Agents (CAA). This means we have the authority to certify passports and submit ITIN applications for people. The other perk is we have access to a dedicated CAA hotline. We can easily get updates on applications and even receive newly assigned ITIN numbers over the phone. While I realize some sellers are cost sensitive, there are many advantages to working with a CAA for these types of services. 

    I'm sorry you're having to deal with this. Someone will have to contact the IRS under POA to get an update. I'm confident in Mary's ability to assist you with this.
