Homework! I am excited to facilitate a discussion on underwriting title to railroad lands at ALTA One in Colorado Springs next week. There are many federal and state laws as well as court decisions that affect title to railroad lands. Given we will be gathering from many states across this great land of ours, I was thinking it might be fun to hear what state statutes specific to railroad land from your state of origin could be a snare for the unwary. For example, some state statutes give the state a right of first refusal on the railroad's sale of its rail corridor. What's in your state?
